Terms and Conditions

The following statement appears on the Texas Educator Certification Examination Program website regarding Testing Policies and has been agreed to by all registrants for Texas Educator Certification Examinations. “Security of Exam Materials: Because of the great cost expended to develop the Exam Materials, because of the obvious necessity that they are kept confidential and secure from disclosure in order to fairly and effectively perform the exam functions for which they were designed, and because any disclosure of part or all of the contents of the Exam Materials to anyone might render them unusable for future exam administrations, I promise and agree that I will not discuss with anyone or reveal in any manner the Exam Materials or any part of them (including the form, subject matter, substance, and wording of any exam question or answer).

I understand and agree that if I should violate this agreement concerning security of Exam Materials, I may be liable in damages for the costs (including redevelopment costs) incurred as a result of any breach of this agreement, and I may also be subject to other legal and equitable remedies (including injunctive relief) for any such breach, by TEA, SBEC, and/or Pearson.

In addition, this statement regarding plagiarism has also been agreed to by registered exam candidates,

Plagiarism: I understand that Pearson reserves the right to cancel my scores if, in its judgment, there is evidence that writing or speaking response includes text that is substantially similar to speech found in other PACT, TExES, or TASC/TASC–ASL responses, or quotations or paraphrasing or language or ideas in published or unpublished sources used without attribution. Such responses do not reflect the independent speaking or compositional writing skills that the exams seek to measure.

For this reason, Teacher Study Hall does not encourage, engage in, or permit discussion of Exam Materials on our website, during workshops or study sessions, or in any communications.

1.     Personal Uses Permitted.

No material from Teacher Study Hall or any website owned, operated, licensed, or controlled by WETA may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer for your personal, non-commercial home use only, provided you keep intact all copyright and other proprietary notices. Modification of the materials or use of the materials for any other purpose, WITHOUT THE PRIOR WRITTEN CONSENT OF WETA, is a violation of WETA’s copyright and other proprietary rights. For purposes of this Agreement, the use of any such material on any other website or networked computer environment is prohibited.

2.     User’s Obligation to Abide By Applicable Law.

In connection with the use of Teacher Study Hall, you shall abide by all applicable federal, state, or local laws, including those to such areas as libel, slander, defamation, trade libel, product disparagement, harassment, invasion of privacy, tort, obscenity, indecency, and copyright or trademark infringement (“Applicable Law”).

The Information available on Teacher Study Hall may include intellectual property that is protected under the copyright, trademark, and other intellectual property laws of the United States and/or other countries (“Intellectual Property Laws”).

Such Intellectual Property Laws generally prohibit the unauthorized reproduction, distribution, or exhibition of all text, photographic and graphic (art and electronic) images, music, sound samplings, and other protected materials. The violation of applicable Intellectual Property Laws may give rise to civil and/or criminal penalties.

3.     Disclosure of Online Communications.

You are cautioned that any online communications may not be fully confidential. In addition, you should be aware that federal postal regulations do not protect electronic mail.

You should be aware that some administrative personnel of Teacher Study Hall may, in the course of their regular duties, have access to communications for technical or operational purposes. Teacher Study Hall may also disclose any communications to the extent permitted or required by law.

4.     Prohibition Against Rogue Programming.

You shall not post, transmit, or make available in any way through Teacher Study Hall any software or other materials which contain a computer virus, trojan horse, timebomb, worm, or another rogue programming (“Rogue Programming”).

Teacher Study Hall has no obligation to detect the presence of any Rogue Programming. Any downloading of software or other materials or any other use of the Information on Teacher Study Hall is at your risk, and you are advised to take adequate precautions to minimize any loss to your system caused by Rogue Programming, including use of anti-virus programs and proper backup of files.

5.     Content of Information.

You are responsible for the content of any Information you put on the Teacher Study Hall. WETA has no obligation to, and does not in the normal course, monitor or control any Information that is or becomes available on Teacher Study Hall.

WETA reserves the right to review any Information that is or becomes available on Teacher Study Hall. WETA reserves the right to refuse to post or to remove any Information that is, in WETA’s sole discretion, unacceptable, undesirable, or in violation of these rules. However, WETA has no obligation to exercise such reservation of rights by WETA.

6.     Disclaimer of Warranties.

TEACHER STUDY HALL IS PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE, NONINFRINGEMENT, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WETA DOES NOT WARRANT THAT ANY INFORMATION IS COMPLETE OR ACCURATE, THAT TEACHER STUDY HALL WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY INFORMATION IS FREE OF ROGUE PROGRAMMING.

7.     Limitation of Damages.

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL WETA BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM THE USE OR INABILITY TO USE TEACHER STUDY HALL, INCLUDING WITHOUT LIMITATION USE OF OR RELIANCE ON INFORMATION AVAILABLE ON TEACHER STUDY HALL, INTERRUPTIONS, ERRORS, DEFECTS, MISTAKES, OMISSIONS, DELETIONS OF FILES, DELAYS IN OPERATION OR TRANSMISSION, NONDELIVERY OF INFORMATION, DISCLOSURE OF COMMUNICATIONS, OR ANY OTHER FAILURE OF PERFORMANCE.

8.     Release and Indemnity.

YOU HEREBY RELEASE AND WAIVE ANY AND ALL CLAIMS AND/OR LIABILITY AGAINST WETA ARISING FROM OR IN CONNECTION WITH YOUR USE OF TEACHER STUDY HALL. YOU ALSO AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS WETA FROM AND AGAINST ANY AND ALL CLAIMS OR LIABILITY, INCLUDING COSTS AND ATTORNEYS FEES, ARISING FROM OR IN CONNECTION WITH YOUR USE OF TEACHER STUDY HALL OR FAILURE TO ABIDE BY APPLICABLE LAW.

9.     Modifications.

These rules may be modified by WETA from time to time and such modifications will be binding on you when placed online.
